In addition 4YOU AIRLINES offered so called “tramp services”, in July and August 2014 (charter flights without accommodation). Previously the company was leasing aircrafts running its activity as a travel agent and selling service in the form of a package – air ticket and insurance.
In order to check if the trader properly informs consumers on the type of its activity the Office of Competition and Consumer Protection has commenced an initial investigation procedure since the 26th August this year. The subject of that action has been also the sales process itself.
Apart from that the OCCP has informed the relevant prosecution office about the suspected offense of fraud (as defined in Art. 286 of Polish Penal Code) in relation to the above activity of the entrepreneur.
Information for the consumers:
In this situation, the OCCP informs consumers who have made purchases through the website of 4You Airlines that those who paid by credit card can use charge-back option for refund.
If the suspicions of the OCCP confirms, consumers will be able:
– to take advantage of the right to cancel the agreement with reference to the provisions of the Civil Code concerning the inability of fulfilling the contract,
– if the consumer finds that he has been misled, on the basis of the Act on combating unfair commercial practices, to demand cancellation of the contract and refund of the paid price.
