Representative of the rental company didn’t have any objections about the condition of the car. The next day, however, the company informed the consumer that had to withhold 65 euro from deposit because of the need of cleaning up the car.

According to the consumer, the agreement provided for the consumer to pay a security deposit but only in the event of damage. Meanwhile, the Spanish trader claimed that the contract contains a provision that forms a basis to conclude that getting dirty is the same as damaging the car.

The agreement was drawn up only in Spanish, which made more difficult for the consumer to demonstrate its point of view.

The consumer sent an email with information that he didn’t agree to pay additional amount of money. Entrepreneur ignored this message and kept 65 euro from deposit. Dissatisfied customer wrote then complaint via the company’s website. But there was still no response from his side or refund of taken money.

In the meantime, the consumer has found in the Internet a lot of negative entries about that rental company and its unfair practices.

The consumer asked for assistance of the European Consumer Centre in Poland. The case is now being solved jointly with Spanish center (Centro Europeo del Consumidor en España).
