At this stage the consumer should contact the company which sold him tickets (OLT Express Regional or OLT Express Poland) and lodge a complaint with request for reimbursement and payment of compensation under Reg. 261/2004 if concerns.

European Consumer Center in Poland reminds that passengers, who bought the tickets from OLT Express, should contact with OLT Express as soon as possible to make a complaint and establish the rules of returning amount of money which was paid and get possible compensation.

All passengers who paid for the tickets by credit card or OLT Express web page or from a tourist agents should apply for a refund to a bank, which will ask a card issuer for a chargeback on behalf of a client.

Furthermore ECC Poland reminds the passengers’ rights in situation of flight cancellation and how to assert claims when insolvency procedure motion is lodged.

In accordance with the provisions of Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295/91 (Journal of Laws of UE L 46 of 17 February 2004) passengers concerned this cancellation are entitled to choose between the refund of full tickets cost and the re-routing under the comparable conditions to their final destination at the earliest possible time depending on the availability of seats.

In addition, the passengers concerned have the right to the compensation from the operating air carrier in the amount of 250 € unless they have been informed about the cancellation at least with 2 week notice before the scheduled departure or the air carrier offered them the re-routing which allows them the departure and arrival to their final destination in such a period of time in relation to the scheduled departure and arrival time, which the offer excludes or limits the indemnification liability of air carrier.

Wherefore, if the passenger had been informed about the flight cancellation before lodging the motion for bankruptcy and complies with conditions above mentioned as well as the details of the cancellation was not at all and the passenger was informed that he doesn’t fly at the time of appearing in the airport, then he is entitled to claim compensation not only on account of flight tickets refund but also under the compensation for the cancelled flight.
